Throughout my career, I’ve heard scary things about trademarks. Secretaries would beg me to avoid trademarks. I would attend Continuing Legal Education classes where the presenters would call trademarks “deceptively difficult” and insist that other lawyers not try to do a trademark unless those lawyers have already done 1000 of them.
Frankly, they were all full of it. Sure, there are things trademark filers need to know to get the most out of the system. But I’ve learned that people who call trademarks “deceptively difficult” are trying to keep other lawyers out of their niche and full of bluster without any substance. I started doing trademarks and then did them more and more frequently until I was preparing a new trademark application almost every day on average.
On a layover in Seattle, I started thinking, with my newfound experience, about the trademark process and what about it was so “deceptively difficult” all those years before. I thought about some of the services out there that offer trademark filings for prices that are less than what the U.S. Trademark Office charges for filing fees. Later, after you’ve paid for a trademark application, you find out that it doesn’t cover the filing fees, no one did any searching, and you ended up paying twice what you expected with potential fees to pay in the future. I decided that night in Seattle that there had to be a better way.
The reality is that trademarks aren’t that hard. There is some nuance and there is some “how to” but there is no reason a person can’t file a trademark and save some money. I talked to my business partner and told him about my idea for a “trademark wizard” that would teach people everything a person needs to know to file a trademark application with the option to upgrade to get an attorney supported product. We wanted to give people the information to make informed choices about whether or not searching is worth the cost.
