ImageAltHow long does it take to get a registered trademark?

The entire process takes about a year and a half to register your trademark. To receive a response from the Trademark Office takes between 10 months to a year in our experience. So, the sooner you file the better. Early filings put you in the earliest position possible in the proverbial trademark line. In the meantime, for DIY+™ and DIY Attorney, ™ we monitor your trademark and let you know when we hear from the Trademark Office.

Yes, you can! It takes some time and effort but if you are willing to learn you can file it yourself and the process will be less expensive than using an attorney. If you don’t want to do every step there are “a la carte” service, one of our qualified attorneys is ready to help you move to the next step.

Whether you individually do your search or if an attorney does you search, we highly recommend having a search done. Searches can give you an idea of the likelihood of registration. A search can also help you decide whether or not it is worth filing your application based on whether or not someone else is using a similar trademark for similar goods or services.

If you have all the required information, it is possible to file the same day. Generally, it takes 2 – 3 days to file your application.

Yes, you can file an “intent to use” application. This filing does not require evidence of use at the time of filing. The evidence of use will be due about a year after filing your application. It will require an additional fee to file your evidence of use, due at the time of filing. 

Your goods and services are an identification of the products or services you are or will sell with your trademark. The Trademark Office organizes all goods and services into 45 classes. Your particular goods and services may overlap in multiple classes. The Trademark Office requires a filing fee for each class of goods or services which means that each trademark class must be its own application.

Your identification of goods and services should include only goods that you are currently selling or that you intend to sell. All of those goods or services listed in your trademark application should also be sold for as long as you intend to keep your company. If you are filing an actual use application do not include goods or services in your identification of goods and services that you are not currently selling.

You can file a trademark for multiple classes in one application. But you still have to pay a filing fee for each class. Since you have to pay the same filing fee anyway, there is no reason to file multiple classes in one application. Each of your trademark registrations will be independent of the others and simplifies the process procedurally.
